Civil is different from Criminal on one major aspect; In Criminal System we have punishment together with penalty whereas in Civil cases the Court can only penalize and compensate for the wrong doing. In fact, in civil cases we don’t call “Offence” it is called Civil Wrong but in Criminal case we call it Offence. The procedure with regards to handling of cases differs in Criminal Case and Civil Case. In Criminal Case the State takes responsibility of punishing the offender. Even, if the State does not come forward to punish the Offender in Criminal Case then the victim has an opportunity to move the Criminal Court directly. Whereas in Civil Case the State does not have role to play, everything has to be done by the Victim/Aggrieved person only.
