WHAT ARE THE DIFFERENT STAGES IN TRIAL IN POLICE CASE?

In Criminal Laws, there are few stages in Trial and they differ according to the status of the Complainant – if the Complaint before the Court instituted by the Police, then the procedure is bit longer and when the Complainant is a private person or a statutory bodies then the procedure is short.

Firstly, framing of Charge under Section 228 of Cr.P.C. if the Trial is before the Sessions Court and Section 240 of Cr.P.C. if the Trial is conducted by the Magistrate Court.

Secondly, Questioning under Section 313 of Cr.P.C.

Thirdly, Chief Examination of Prosecution of Witnesses

Fourthly, Cross Examination of Prosecution Witnesses

Fifthly, Chief Examination of Accused Witnesses

Sixthly, Cross Examination of Accused Witnesses

Seventhly, Questioning of Accused under Section 313 Cr.P.C. Sixthly, Oral Arguments / Memorandum of Arguments under Section 314
