It is mandatory on the part of the Police to follow certain procedures as per the Code of Criminal Procedure, 1973 after it receives the Complaint. The Accused requires to be summoned under Section 41 of CRPC. The Police summons the Accused to the Police Station for inquiry on a pre-determined date.
While on the determined date, an inquiry will be conducted by the Investigation Officer. The Complainant and the Accused were being heard, then based on the findings, prima facie commission of offence was sensed by the IO, he then convert the CSR into FIR.
If offence does not make out or falls beyond the Police domain to conduct any further inquiry into the Complaint it directs the Complainant to approach him to appropriate Court to get remedy and close the CSR therein.
