In a Police based Complaint, the Jurisdiction Court does not look much on the maintainability and admission of the case – as another wing of the Judiciary – Prosecution – took a view of the case details and gave its assent on both factors; maintainability and admission of the case. The crux is – the Jurisdiction Court shows somehow lenient attitude towards the Prosecution on both counts.
Whereas, in a Private Complaint instituted under Section 200 Cr.P.C. the Complainant has to establish both factors maintainability and admission of the case.
Maintainability relates to jurisdiction of the Court, limitation, cause of action and such similar things. Whereas, once you cross the milestone of Maintainability, the Complainant was put under a test of testifying his Statement vis-à-vis contents of his Complaint. Should the Statement given by the Complainant in the Box matches with the Complaint, also the adduced Documents and other Oral Witnesses produced by him corroborates his version and his Complaint, were all seen for admission of the Complaint by the Court.
