WHAT IS POLICE CUSTODY & JUDICIAL REMAND?

An Accused immediately upon his detention by the Police, he is required to be produced before the Jurisdiction Court for his remand.

Remand means “Custody.” Custody is of two types;

  1. Police Custody, and
  2. Judicial Custody

Generally, based on the gravity of offence committed by the Accused and if his custody deems inevitable for investigation and / or for further inquiry, the Police would pray the Court for his Custody and the Court would see the merits of the plea and accordingly allow Police Custody or dismiss the request.

Otherwise, every Accused sent to Jail before the commencement of the Trial is called Judicial Remand.
