What if the Police receives a Complaint, which is non-Cognizable Offence? Whether the Police has powers to take non-Cognizable Offence and investigate the matter similar to that of Cognizable Offence?
Section 155 Cr.P.C. has answer to those questions. Criminal Law bifurcates nature of offences under cognizable and non-cognizable cases. Wherein, offences of cognizable nature does not demand of the Police to obtain warrant of arrest from the concerned Magistrate.
However, for non-cognizable offence, the Respondent Police has to secure warrant of arrest from the Magistrate and also for any inquiry to be conducted it has to get prior permission of the Court.
Should a non-cognizable offence coupled with cognizable offence then the Police is empowered with all the powers of cognizable offence and it can arrest a person without warrant and or obtaining necessary approvals to conduct investigations.
