DRAFT CONSTITUTION RECEIVED INSUFFICIENT AND INADEQUATE ATTENTION!

On 5th November 1948 Mr. C. Bishwanath Das [Orissa General] spoke in the Constituent Assembly as follows;

“Changes have been made in the Constitution without a decision of the Assembly.”

Sir, “…having stated so far about the decision taken by the Drafting Committee itself, come to the question of the Draft Constitution. Sir, the procedure adopted by the Honourable President regarding discussion of the Draft Constitution is, I am afraid, peculiar. It is neither the procedure that relate to a bill nor the procedure that has been followed in other Constituent Assemblies. We constituted the Drafting Committee on the 10th August 1947. After six months of labour, a report was presented to the Honourable Members of this House. The report was circulated about the middle of February 1948 and a very short time was given for Honourable Members to place their views before the Committee. I must frankly confess that not only was the time given to us short, but, a time that was chosen for offering suggestions was very inopportune in the sense that both the members of the Central Legislature and also members of the Provincial Legislature were busy with their Budget. Therefore the attention that was necessary and that ought to have been given to such an important thing was not given for no fault of the Members themselves. Thus help each the Drafting Committee must have received or has received necessarily remains very small and inadequate.”

It is evident from the speech that sufficient time was not given for the reason best known person’s incharge, with the result the Draft Constitution was not given thorough analytical deliberation.
