WITNESS EXAMINATION BY POLICE

Section 161 of Cr.P.C. deals with the Police’s examination of witnesses.

An IO or the Police Officer appointed by the State and under latter’s instructions such Officer can examine orally any person who is acquainted with the facts and circumstances of the case.

Such person who is subjected to examination would truly answer to all questions pertaining to the case asked by such Officer and even that might expose him of criminal charge, penalize him and his property might be forfeited.

The IO can record the statement in writing of each such person whom he examines.

[This Provision was inserted with a portion in the year 2009 that there was no restriction to record statements by audio and or video and or by any other electronic mode desires by the IO.]

[This portion of the provision was inserted in the year 2013 which fixes responsibility on the Woman Police Officer or any Woman Officer to conduct inquiry of a rape victim or a woman who was sexually assaulted / attempted or modesty was outraged]
