Section 172 Cr.P.C. deals with a situation relating to the dairy of proceedings in investigation.
The IO who investigate the offence must enter the proceedings in a diary kept by him, enter the time of information reached him, he started and closed the investigation, places he visited and the statement ascertained by him through investigation.
1-A the 161 statement recorded by him must be entered into the diary
1-B the diary must be duly paginated
Any Criminal Court may use the diary to aid the inquiry or trial
The diary shall not be given to the Accused or his agents, nor are they allowed to see it. But the diary shall be used by the IO to refresh his memories. Even the Court can use it to contradict the IO. Otherwise, Sections 161 and 145 of the IE Act shall apply.
