The Sessions Court Judge and Additional Sessions Court Judge authorised by law to pass judgment ranging any sentence including that death punishment or imprisonment for life. But as far as death penalty is concerned the Court passing such Judgment must get concurrence from the High Court.
Whereas, the Assistant Sessions Judge is empowered to pass Judgment less than 10 years.
The Chief Judicial / Chief Metropolitan Magistrate has powers to pass a sentence less than 7 years. Whereas First Class Magistrate can pass sentence of imprisonment less than 3 years or less than Rs. 5000 fine, or of both. The Second Class Magistrate can pass sentence less than 1 year or fine not exceeding Rs. 1000/- or, of both.
