The Special CBI Court yesterday delivered its much awaited Judgment in the Babri Mosque demolition conspiracy after delving into trial of this case for more than a decade. Finally, the Court acquitted all the 32 Accused named in the conspiracy theory of ransacking the 16th century old Mosque and it pronounced – the Mosque was demolished by anti-social elements, but no Leaders were involved.
The Court based on the evidence of Witness Anju Gupta, who was Additional Superintendent of Police than and who was pressed into the services of giving protection to Advani claimed that dacoits and criminals were mingled amidst kar sevaks and downed the structure. The Court even based on such version condemned the District Administration for not having acted on the intelligence report on the intrusion of anti-social elements. Since copy of the 2,300 pages Judgment is still not obtained by us, a detailed study of the Judgment at this stage is not possible.
Whereas the Court without any ambiguity puts onus on the Prosecution for its failure to produce supporting materials so to prove the case. Media report suggest that 161 statement [generally collected by the Police from the witnesses before filing of the Chargesheet] vis-à -vis the evidences tested under oath by the Prosecution in the Court mismatch, and on top of it, the self-acclaimed Country’s best investigating agency, CBI, had largely depended its case on the media clippings, audio and video recordings, nothing beyond that it did see in support of its case. Otherwise, it literally failed in proving the case by not presenting negatives of the picture, forensic of the voices and such similar things.
Earlier the land was assigned based on belief and now acquittal is made based on no proof, where are we heading?
