This week two notable, yet remarkable, developments have taken place in Tamil Nadu State Judiciary. One is Justice Duraisamy’s humane judgment and another is Chief Justice of Tamil Nadu’s preference to face his medical check-up with the State run Government General Hospital.

In an in-direct Democracy like ours, it is not alone the people who requires to keep trust and faith on our elected representatives, but, the rulers who must have faith on the machineries first, which functions under it, like our Government run Hospitals. In the Covid 19, we saw many of our elected representatives and ministers rushed to Private Hospitals. In contra, the Chief Justice of Tamil Nadu preferred his examination in the Government Hospital, he thereby not only broken superiority myth of Private Hospitals but exemplified his wisdom – not to spend in a private hospital unnecessarily for such ailment, which has no medicine. Justice Duraisamy brought reminiscence of our judicial luminaries; Justice Krishna Iyer and Justice Bahagavathy – it was these two stalwarts of Indian Judiciary who were then Judges of Supreme Court gave new identity to Writ Filing – they broke the myth from filing a neatly drafted Petition to just a Postcard – they felt – it was sufficient for High Court and Supreme Court to take notice of the grievances of a remotely living Citizen of this Country – who does not have resources to fight for his justice by coming to High Court or Supreme Court.
Compassionate Judges are rare breed and Justice Duraisamy of Madras High Court is one now in this line. He acted swiftly on a letter sent to him by a victim’s Father – bringing to the notice of the High Court – the negligence committed by Tamil Nadu Electricity Generation Company [TANGEDCO] – over snapping of overhead cable – his unmarried young Son [preparing for competitive exams] got killed due to electrocution. The Judge visited the spot and assessed ground reality then pronounced his Judgment in favour of the Father – ordered TANGEDCO to pay deceased Father about 13 lakhs compensation.            Â
Needless to say, TN Judiciary has always been on the forefront in performing its constitutional obligation in the Country. Our State judiciary from its inception about 158 years from now had Gem of Judges who adored our Madras High Court. In naming them, even if we miss one name, we think it is an injustice on our end we committed to that Gem, hence instead naming them, we collectively remember each of them for their contribution in justice delivery system in the State.
