HOW TO MAKE SEARCH IN ANOTHER STATION LIMIT?

Section 166 of Cr.P.C. deals with a situation wherein an Officer Incharge of one Police Station calls another Station Incharge to issue search warrant.

An Incharge of a Police Station or a Police Officer of a rank not less than a Sub Inspector while on investigation cause search warrant to the Officer of the other Police Station within the same district or other district to conduct search in its limit.

The Officer who has received the search warrant follow the narratives of Section 165 of Cr.P.C. and forward the searched items to the Officer on whose instance he conducted the search.

It is lawful for the Investigation Officer of one Station limit to conduct search in other Station limit in accordance with Section 165 of Cr.P.C. when he has reason to believe that it might delayed the process of investigation and or the evidence might be concealed or destroyed by the time other Station limit Officer conduct search.

The Officer who is contemplating to conduct search in other Station limit must serve a notice of search together with the list [if any] prepared under Section 100 Cr.P.C. to Incharge of the other Police Station in whose limit he is inclined to conduct search. Similarly, it should also be sent to the concerned Magistrate of other Station limit together with the copies of the record referred in Section 165 of Cr.P.C. to his notice to take cognizance of the offence therein.

The concerned Magistrate of the other Station limit might produce the copies of the record free of cost to the owner / occupier of the searched place on latter furnishing an application.
